1. Introduction
Welcome to ABTurns ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our nail salon management system and related SMS notification services. By using our services, you agree to be bound by these Terms.
Our services include appointment management, customer check-in systems, and SMS notifications for appointment reminders and updates. Please read these Terms carefully before using our services.
2. SMS Messaging Terms
2.1 Service Description
When you opt-in to receive SMS messages from participating nail salons using ABTurns, you will receive appointment confirmations, reminders, updates about wait times, and promotional offers from the salon. Message frequency varies based on your appointment schedule and salon communications.
2.2 Consent Requirements
By providing your phone number and opting in to SMS notifications, you expressly consent to receive automated text messages from the salon at the phone number provided. Consent is not a condition of purchase. You understand that consent can be revoked at any time.
2.3 Message Frequency and Charges
Message frequency varies based on your appointments and interactions with the salon. Standard message and data rates may apply. Please contact your mobile carrier for details on your plan and any applicable charges.
2.4 Opt-Out Instructions
You can cancel SMS services at any time. Text STOP to any message you receive from us. After you send STOP, we will send you an SMS message confirming that you have been unsubscribed. After this, you will no longer receive SMS messages from that salon.
2.5 Help and Support
If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance, or contact us at support@abturns.com.
2.6 Supported Carriers
Our SMS services are compatible with major U.S. carriers including AT&T, Verizon, T-Mobile, Sprint, and others. Carriers are not liable for delayed or undelivered messages.
3. TCPA Compliance
We comply with the Telephone Consumer Protection Act (TCPA) and all applicable regulations. Messages will only be sent between 8:00 AM and 9:00 PM local time. We do not sell, rent, or share your phone number with third parties for marketing purposes.
We maintain records of all opt-ins and opt-outs as required by law. By opting in, you certify that you are the authorized user of the phone number provided or have the authority to consent on behalf of the authorized user.
4. User Responsibilities
You agree to:
- Provide accurate and current information
- Maintain the confidentiality of your account credentials
- Notify us immediately of any unauthorized use of your account
- Use the services in compliance with all applicable laws and regulations
- Not use the services for any illegal or unauthorized purpose
- Not interfere with or disrupt the services or servers
5. Service Modifications and Termination
We reserve the right to modify, suspend, or discontinue any part of our services at any time with or without notice. We may also terminate or suspend your access to the services immediately, without prior notice or liability, for any reason.
6. Privacy
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ABTURNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL ABTURNS' TOTAL LIABILITY EXCEED THE AMOUNTS PAID BY YOU TO ABTURNS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
8. Indemnification
You agree to indemnify and hold harmless ABTurns and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the services.
9. Dispute Resolution
Any disputes arising out of or relating to these Terms or the services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the State of Florida.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
11. Changes to Terms
We reserve the right to update these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the services after any changes constitutes acceptance of the new Terms.
